Statute Description:
School systems should collect data regarding student reading proficiency using an approved instrument (either from the Commissioner's List or selected by a district-level committee) for all Administration and Parental Notification Guidance:
It is recommended that the BOY instruments be administered within the first 60 days of school so that the resulting data can be used for instructional purposes.
Families should be notified of BOY results within 60 days of administration.
Dyslexia Screening
TEC §38.003 and the State Board of Education require that school systems administer universal dyslexia screening for grade 1 students by January 31. The updated Dyslexia Handbook provides current screening criteria. The criteria for English and Spanish screening instruments are as follows:
Grade 1 - Screened by January 31st
Word Reading Accuracy or Fluency
Phonological Awareness
Commissioner-approved reading instruments that meet the requirements of TEC §28.006 (Early Reading Diagnosis) include aligned dyslexia screening elements. These free tools meet the dyslexia screener requirements outlined in the Dyslexia Handbook; however, they are not required to be used by school systems to fulfill dyslexia screener requirements. School systems should ensure planned dyslexia screening instruments meet the revised criteria.
Discontinuation of Early Reading Indicator (ERI) Data Element Collection
Effective immediately starting the 2025-26 school year, the Early Reading Indicator Data Element will no longer be collected through PEIMS. This change resulted from the repeal of the statutory requirement that was the basis for the data collection.
Additional Information Related to HB 2, Article V
HB 2, Article 5 requires the commissioner to adopt lists of reading and mathematics instruments for districts to use at the beginning of year (BOY), middle of year (MOY), and end of year (EOY) in kindergarten-grade 3 to measure foundational literacy and numeracy skills. HB 2 permits a school district to comply with the requirements to administer these instruments by administering a reading or mathematics instrument selected by the board of trustees of the school district that meets statutory requirements until the commissioner adopts the list of reading and mathematics instruments. Additional guidance regarding the future implementation of reading and math instruments as required by HB 2, Article V, will be communicated later.
Note: The information below reflects current instrument administration requirements for the 2025–2026 school year. School systems should continue to follow the 2025–2026 school year requirements.
